These Terms and Conditions of Use ("Terms") govern your access to and use of the Doctor Fran mobile application and any related services (collectively, the "App") operated by Doctor Francis Ojukwu Professional Medicine Corporation ("Doctor Fran", "we", "us", "our"). By creating an account and using the App, you agree to be bound by these Terms. If you do not agree, you must not use the App.
Doctor Fran owns and operates the App, a technology platform that connects registered patients in Ontario, Canada with licensed independent contractor physicians ("Authorized Physicians") for the provision of remote medical consultations and related services ("Healthcare Services"). Healthcare Services available through the App include text-based medical consultations, prescriptions, sick notes, fit-to-work letters, specialist referrals, UTI assessments, mental health consultations, insurance forms, lab test requisitions, erectile dysfunction treatment, and medication refills.
To register for and use the App, you must be at least 18 years of age, be a resident of Ontario, Canada at the time you request Healthcare Services, and register with Doctor Fran by providing accurate and complete information. Doctor Fran reserves the right to decline any registration at its sole discretion.
By tapping "I agree" at registration, you enter into a binding agreement with Doctor Fran on the terms set out here. These Terms incorporate by reference Doctor Fran's Privacy Policy, available at doctorfran.com/privacy.
By using the App, you represent and warrant that you meet the eligibility requirements and will continue to do so at the time you request Healthcare Services; all information you provide is accurate, current, and complete; you are authorised to act on behalf of any person for whom you request Healthcare Services; and you will use the App solely for personal, non-commercial purposes.
Doctor Fran is a technology platform. It is not a healthcare provider and does not practice medicine. Healthcare Services are provided solely by Authorized Physicians, who are independent contractors and not employees or agents of Doctor Fran. The relationship between you and an Authorized Physician is a doctor-patient relationship to which Doctor Fran is not a party. Healthcare Services provided through the App do not replace your relationship with your regular primary care provider.
By requesting and receiving Healthcare Services through the App, you consent to receiving medical care from Authorized Physicians through a virtual modality (including by telephone) rather than through an in-person visit. You acknowledge that you understand the nature, benefits, and limitations of virtual care, including that virtual care may not be appropriate for all conditions, that an Authorized Physician may determine that an in-person assessment is required, and that in such cases you will be directed to in-person or emergency care. You may withdraw your consent to receive care by a virtual modality at any time, including by declining to proceed with a consultation.
Consent to any specific assessment, treatment, or prescription proposed during a consultation is obtained by the Authorized Physician at the time of care, in accordance with Ontario's Health Care Consent Act, 1996. Before providing treatment, the Authorized Physician will explain the nature of the proposed treatment, its expected benefits, material risks and side effects, and any reasonable alternatives, and will answer your questions. You may decline or withdraw your consent to any proposed treatment at any time.
Your consent to the collection, use, and disclosure of your personal information and personal health information is addressed in Doctor Fran's Privacy Policy, which forms part of these Terms.
THE APP CANNOT BE USED FOR MEDICAL EMERGENCIES. IF YOU BELIEVE YOU ARE EXPERIENCING A MEDICAL EMERGENCY, CALL 911 IMMEDIATELY OR ATTEND YOUR NEAREST EMERGENCY ROOM.
The following symptoms are not eligible for treatment through the App: chest pain or pressure; difficulty breathing; fever in children under 3 months of age; loss of consciousness or feeling faint; stroke-like symptoms including sudden weakness, numbness, or difficulty speaking; and any abdominal pain severe enough to prevent normal movement.
Authorized Physicians are not permitted to prescribe narcotics, controlled substances, or other medications with high potential for abuse to patients without an established treating relationship. Any prescription issued through the App is solely for the personal use of the individual named on the prescription.
You must not report drug reactions, side effects, or adverse events through the App. Any such events must be reported to your primary care provider, a walk-in clinic, or in an emergency, by calling 911.
You agree that you will not remove or alter any copyright or proprietary notices; reproduce, modify, distribute, or reverse engineer the App; attempt to gain unauthorised access to any part of the App; use automated tools to scrape or data-mine the App; impersonate any person or entity; or use the App in any manner that violates applicable law. You are responsible for all activity that occurs under your account. You may only hold one account with Doctor Fran.
Doctor Fran charges a fee for each consultation. All fees are in Canadian dollars and inclusive of applicable taxes. The applicable fee will be displayed before you confirm your consultation request. All Consultation Fees are non-refundable once a consultation has been completed. If you have a concern about a charge, please contact us at [email protected].
Doctor Fran may offer a referral program that allows Users to earn credits towards future Consultation Fees. Referral Credits are issued when a referred individual registers and completes their first consultation. Credits expire 24 months from the date of issue, have no cash value, and may only be shared for personal, non-commercial purposes. Doctor Fran reserves the right to modify, suspend, or terminate the referral program at any time.
Doctor Fran's collection, use, and disclosure of your personal information and personal health information is governed by the Privacy Policy, which forms part of these Terms.
Doctor Fran may suspend or terminate your access to the App at any time and for any reason, with notice to you. You may close your account at any time by contacting us at [email protected].
The App, including all content, design, software, and brand elements, is the property of Doctor Fran or its licensors. Nothing in these Terms grants you any right to use Doctor Fran's name, logo, trademarks, or other brand elements without prior written consent.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE." DOCTOR FRAN MAKES NO REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE APP OR THE HEALTHCARE SERVICES. DOCTOR FRAN DOES NOT GUARANTEE THE AVAILABILITY, ACCURACY, OR CONTINUITY OF THE APP, OR THE QUALITY OR OUTCOME OF ANY HEALTHCARE SERVICES. YOU ASSUME ALL RISK ARISING FROM YOUR USE OF THE APP.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DOCTOR FRAN SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP; ANY HEALTHCARE SERVICES PROVIDED OR NOT PROVIDED BY AN AUTHORIZED PHYSICIAN; OR ANY UNAUTHORISED ACCESS TO OR USE OF YOUR ACCOUNT OR DATA.
You agree to indemnify and hold harmless Doctor Fran and its directors, officers, employees, and contractors from any claims, losses, liabilities, damages, and expenses arising from your use of the App, your breach of these Terms, or your violation of the rights of any third party.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario.
